Auctioneers Note:  John Sisk Auctioneers. Inc. has been commissioned by creditor's to sell out the contents of Citko's to
                              the highest bidder.  In an effort to keep the restaurant in this location, the landlord is willing to work
                              with qualified person(s) to negotiate a lease.  This Restaurant was opened less than 2 years and
                              immaculately kept.


Directions:
 Traveling South on IH-37 follow it all the way downtown and turn Right on Ocean Drive.  Follow Ocean Drive
                   till you come to Louisiana St. and turn Right.  Go to Sante Fe St and turn left.  Citko's (2766 Sante Fe will be
                   in the next block on your left side.)

Viewing: FRIDAY, APRIL 25TH from 10am till 4pm; Saturday, Sale Day from 8am till 10am, Auction Starts at 10am.

NOTICE: Please take advantage of the viewing times you MAY NOT be able to see the items when they are sold.  We sell
                everything by Number.   An Item list will be provided for your note taking.

YOU MAY NOT BE ABLE TO SEE IT WHEN IT IS SOLD.

 

Announced Terms supersede all written ones.

1. YOU ARE ATTENDING THIS AUCTION AT YOUR OWN RISK. Neither the Auctioneer, nor the Seller(s) assume any responsibility
    while on these premises.
2. As a Registered Bidder,
YOU are responsible for all Terms and Conditions. Announced Terms supercedes all written ones. If you are late in
    registering or didn't listen to the terms, you are agreeing to the terms in their entirety even though you didn't hear or chose not to listen to them.
3. You must have a bidder's number to bid on any item.
4. This list is provided for your convenience and mistakes in typing do occur.  It is up to you the buyer during the specified inspection time to
    determine all aspects and condition of the item you're bidding on. All items are sold
AS IS-WHERE IS. NO GUARANTEE OR WARRANTY
    is expressed nor implied.  The auctioneer in no way is making any representation as to the genuiness or authenticity of the items.  Descriptions
    given us were deemed from reliable sources and therefore used.
ABSOLUTELY NO REFUNDS OR EXCHANGES FOR ANY REASON
    will be given.

PLEASE DO NOT ATTEMPT TO MOVE ANY ITEMS WITHOUT A PAID INVOICE AND ONE OF OUR PERSONNEL ASSISTING
    YOU. 
You may check out as many times as you wish during the auction and continue to bid.

PAYMENT: Cash, Credit Cards; Mastercard, Visa, Discover, American Express, Local Check IF the address on your check matches the
    address on your drivers license. Other Checks with Bank Letter of Guarantee made out to John Sisk Auctioneers for this Auction. Bank Letters
    must be on Bank Letterhead and Bank Letters must indicate the amount of Check Guarantee.  Original Letters Only.  No Photocopies will be
    accepted. Auctioneer reserves the right to refuse to take a check from anyone. You may PAY-OUT as many times as you wish or anytime you
    wish during the auction. 
PAYMENT IN FULL MUST BE MADE DURING OR WITHIN 30 MINUTES OF THE CLOSE OF THE AUCTION

8. If buyer fails to make payment good in full immediately following the sale the Auctioneer may, at his discretion, Re-Sell such property at public or
    private sale and buyer shall be required to pay any loss or expense incurred therein, including attorney fees and court cost. (Chapter 2 of the
    Texas Business and Commerce Code)

This auction sale IS subject to the Sales Tax Laws of this State.
10. Any bidder buying for Resale, must have their 11-digit Texas Sales Tax Number and EXEMPTION APPLICATION filled out and in our file
      prior to the start of this Auction. Or, if you will be buying under Farm Exemption, please tell the cashier what items/lot#'s your claiming as
      exempt.
11. The Auctioneer is in full control of the Auction and reserves the right to settle any dispute between bidders.
12. Bid Increments are at the discretion of the Auctioneer.
13. There will be a 10% Buyers Premium added to all purchases. Example: If an item sells for $100.00, then add 10% =$10.00=$110.00. Buyer
      pays sales tax on total.

Deadline for Removal; SMALL ITEMS TODAY - SALE DAY .  OTHER ITEMS - SUNDAY, APRIL 27TH 10AM TILL 2PM,  Neither the
      auctioneer nor the seller are responsible for any item left overnight.
     
NOTICE:  AS THE REGISTERED HIGH BIDDER YOU ARE RESPONSIBLE FOR THE REMOVAL OF ALL EQUIPMENT.
      TERMS FOR REMOVAL ARE PRINTED ON SEPARATE COPY AND AS A REGISTERED BIDDER YOU ARE AGREEING
      TO THE TERMS OF REMOVAL.  THESE GUIDELINES WILL BE STRICTLY ENFORCED

15. All items are sold times the quantity unless announced by the auctioneer.
16. Personnel working this Auction
CAN NOT load items.
17. This Auctioneer is Licensed, & Regulated under a State Issued Recovery Fund. This Fund protects both the Buyer and Seller from inappropriate
      and fraudulent actions by this Auctioneer. This Auctioneers License #7425. Information concerning this Recovery Fund or this Auctioneer may
      be obtained by contacting the State Department of Licensing and Regulation, P.O. Box 12157, Austin, Tx 78711, or by calling 512 463-2906.
      This doesn't imply endorsement by the State of Texas.

19. This auction sale is being electronically and manually recorded.



                                                       
TERMS FOR REMOVAL OF EQUIPMENT

 
1.  ALL items should be removed by Qualified/Trained persons such as Licensed Plumbers and Electricians.
 2.  You may remove electrical flex type conduit back to the junction box on the wall provided bare wires
      are covered with approved wire nuts and taped w/ electrical tape.  Junction boxes must have a cover on them.
 3.  Plumbing lines may be taken back to the cutoff valve.  NOTE: If there is no cutoff valve-one must be installed.
      No water lines are to be left open-ended or dripping water.
 4.  Any holes in roof as a result of removing equipment must be repaired as to not allow any damage from outside
     elements such as rain etc. to enter the inside.  If there is openings either left or not adequately repaired and
     damage occurs, the buyer will be held accountable and liable for damages/repair.
 5.  Any damage to walls, ceilings, floors or doors as a result of moving equipment out to be loaded is the
      responsibility of the buyer.
